Nikki: Here, have some juice.

Victor: Any word from Ryan and Tricia?

Victoria: No, not yet.

Victor: What shape was she in when you last saw her?

Victoria: She was a wreck.

Nikki: Let's hope she helps us.

Victoria: We’re hoping she wants to.

Nikki: Doesn't the D.A. Know he has nothing to do with selling drugs?

Victoria: I'm sure everything will work out.

Nikki: When, Victoria? Matt Clark's name is on record. It's very obvious Nicholas is innocent. I don't understand this. Why is this happening? I get the feeling something is going on that I don't know about. What is it?

Victor: Let me explain it to you. The police are interrogating Nicholas about Matt Clark’s death.

Nikki: What does he have to do with that?

Victor: Nicholas was found in Matt Clark's room holding the guy's breathing tube. Matt Clark new he wasn't going to survive nor was he going to get away with his crimes. He ripped out the breathing tube and placed it in Nicholas' hands.

Nikki: Now Nicholas is charged with his murder.

Victor: Right. It doesn't mean he'll be convicted.

Nikki: This is so unfair. This whole thing should be Over now. We shouldn't be going back to jail for good.

Nicholas: He will.

Nikki: How do you know that? How does any of us know that? What if he's convicted?

Ryan: Tricia? Trish?

Tricia: What's going on?

Ryan: We need to ask you some questions. You know John Silva? This is detective Edmonds, Genoa City P.D.

John: We met. How are you, Tricia? I also brought a court reporter to record everything you say.

Tricia: You're going to ask me questions?

Ryan: All you have to do is tell the truth. Can you do that?

John: Okay then. Why don't we get started. The court reporter needs to swear you in, okay?

Tricia: I won't lie.

John: I know. It's just a formality. -- Do you  solemnly swear the testimony you are about to give will be the truth, the whole truth and nothing but the truth so help you God? -- For the record, tell us your name.

Tricia: Tricia McNeil.

John: And do you know where you are?

Tricia: In the hospital.

John: Do you know why you're being questioned?

Tricia: I think so.

John: Do you realize the testimony you are about to give could be used against you in a court of law?

Tricia: Yes.

John: Has anyone told you how you should respond to any of these questions?

Tricia: No. But I should tell the truth.

Tricia: Anyway, I was upset at Victoria Newman for destroying my marriage. Carter said that I could get payback. I didn't -- I didn't think that he would cause any real harm. That's when I told him about your computer.

Ryan: Right.

Tricia: I asked you for your password. You said that there was stored in the computer. Carter said to bring it to him. So I did.

John: Do you know when that was?

Tricia: The end of last year.

John: Can you be more specific? Think, Tricia. It's very important.

Tricia: I think I remember hearing something on the radio about pearl harbor day.

Ryan: December 7th.

John: Let's get back to the computer. Did Carter tell you what he did with it?

Tricia: He tapped into files at Newman enterprises. I thought he was just going to make Victoria look bad, you know? But then later, he told me that he framed Nick.

Ryan: What? What is it, Trish?

Tricia: He said that I helped him set up Nick. I didn't. I swear I didn’t know. I didn't know about that. I didn't know about that.

John: You didn't know about that. -- You didn't know about what?

Tricia: I can't tell you. I can't tell you.

Brad: There you go, one cup of coffee, hot, black and strong, just what you need to start your day. Still thinking of inviting your dad over for dinner?

Ashley: Yeah, I guess.

Brad: We still didn't talk about last night. You're still upset that Phyllis is living under the same roof with Jack. Why don't you want to talk about it?

Ashley: Maybe I'm just so furious about it. Sorry, that was out of line. I can't talk about this. Let me settle down a bit, okay? [Doorbell rings] I'm sorry.

Brad: I'll get it. You know people we like don't stop by this much.

Jill: Thank you, Bradley. I need to talk to you.

Brad: Come on in. Maybe we should get you your own key.

Jill: My, this is a cozy moment.

Ashley: It was.

Brad: What brings you by this spring morning?

Jill: Have you seen anything curious?

Brad: Have you seen the paper?

Jill: It wouldn't be in the paper. I won't spread the word. I'm not a gossip.

Brad: You must be talking about Phyllis moving in with Jack.

Jill: You do know.

Brad: Mm-hmm.

Billy: Morning, Jack.

Jack: Hey, kiddo. Trouble getting out of bed this morning?

Billy: I slept through my alarm. What smells so good?

Jack: Breakfast. Have a seat.

Billy: Did you invite a friend to join us?

Jack: As a matter of fact --

Phyllis: Not just a friend. A new roomy.

Billy: What?

Phyllis: Jack and I decided to move in together. Isn't that great?

Billy: Yeah, yeah, that's terrific.

Phyllis: I took the liberty of cooking for everyone. There you go. There's the eggs. I have the sausage in the kitchen. I'll just go get those.

Billy: So you and Phyllis, huh?

Jack: Yeah, she -- well, we decided it was time.

Billy: I didn't know it got that serious.

John: Good morning, everyone.

Billy: So you were surprised too.

John: You could say that.

Jack: Phyllis realizes if it doesn't work out here, we can go somewhere else. Nothing's written in stone, right, dad?

John: Pass the business section, please.

Phyllis: Good morning, John.

John: Good morning, Phyllis.

Phyllis: I hope everybody is hungry. I made enough to serve an army. Since I'm the new girl in town, I'll serve.

Jack: Phyllis, everything looks wonderful.

Phyllis: I had a hard time following -- finding my way around. The kitchen is so spacious. John, I forgot your bran.

John: What?

Phyllis: The bran. I saw it in the cabinet. I just thought it was yours. I'll go get it. Don't move.

Jill: Isn't this just great. Jack and Phyllis are living in the Abbott home, and Brad and Ashley are fiddling --

Ashley: Your histrionics are not helping, Jill. Can you leave us alone to enjoy our precious time alone?

Jill: You are jeopardizing everything we worked for.

Ashley: If you think your ranting and raving will change things, you can forget it.

Jill: I'm not wasting my time.

Brad: Honey, where are you going?

Ashley: If she won't leave, I will.

[Doorbell rings]

Olivia: Nate. Aunt Mamie?

Mamie: Never mind us. I know you're getting ready for work.

Olivia: I have time. I thought Sam's mom was taking you to school.

Nate: I forgot my backpack.

Olivia: I haven't seen it around.

Nate: It must be in my room.

Olivia: I could have brought his -- he called you?

Mamie: Yes.

Olivia: I could have brought his backpack.

Nate: I found it.

Olivia: I can drive you to school.

Nate: That's okay. Aunt Mamie, can you help me with the zipper? It's stuck.

Olivia: Did you have fun at Sam's last night?

Nate: Yeah.

Olivia: What did you guys do?

Nate: Watched a movie. His mom made cookies for us.

Olivia: That sounds like fun.

Mamie: There you go. As good as new.

Nate: I'm going to wait for the bus.

Olivia: Make sure you stay with the doorman until it gets here, all right?

Mamie: Bye, Nate.

Nate: Bye.

Olivia: Have a good day. He treats me practically like I'm a stranger.

John: Tricia, is there anything else you can tell us about what Carter did? You know, in order for you to be found guilty you would have to know what Carter was planning.

Tricia: I didn't. I followed him. I asked him what he was doing. Just talk to Nick and Sharon and make them go away.

John: Hold on. When was this?

Tricia: Afterwards he acted so upset about Jordan dying.

John: When was Carter at the hospital?

Tricia: He had a flat tire and he was yelling at me. He said I helped murder Jordan and I was going to jail. He acted like Jordan was his friend but he wasn't. He killed him. I just did what he told me to do. After what happened to Tony, I didn't do anything. I swear.

Ryan: No, we know you didn't do anything knowingly.

Reese: That's enough for now. That's enough for now.

Tricia: Ryan?

Ryan: I'll be back. You rest. Don't you worry. I'll help you. I promise.

Tricia: Ryan?

Phyllis: How does anyone like the eggs?

Jack: I can't remember when I had better.

Billy: I agree.

Phyllis: They're from free-range hens. They're supposed to be better for you. Wow, look that. We need more toast. I'll get some. While I'm up, does anybody want anything, juice, coffee? John?

John: No thank you. No.

Phyllis: You seem like a whole-wheat man to me. I have a couple of extra slices. I'll just plop them in the toaster.

Jack: Okay. So she's trying a little too hard.

John: A little?

Jack: Her heart is in the right place, and I think that's what matters.

Billy: I should get to school.

Jack: Wait a minute, Billy. Dad has something he wants to say to you. This is probably as good a time as any, huh?

Billy: Okay.

Jack: It's about Phyllis and me. Dad has some reservations about our current living situation.

Billy: What do you mean?

John: Son, call me old old-fashioned but I think there are some things that should be saved for marriage, and living together is one of them.

Billy: Dad, you do know that --

John: Wait a minute, Billy. There are some values that are not subject to change. Jack and Phyllis sprung this on me without any warning but I do not endorse it. Understand?

Billy: Yeah.

John: Good. We'll talk about it later, I have to go to the office. Are you seeing Raul today?

Billy: I was heading over to the hospital after school.

John: Please give him my best.

Billy: I will.

John: Jack, thank Phyllis anyway for the toast.

Billy: Sounds like you and dad got into it.

Jack: He feels strongly about his beliefs, and I have to respect him for that.

Billy: For what it's worth, I like Phyllis. It will be cool to have her around. If that's what you want, I'm happy for you.

Jack: Well, thanks, buddy. Thanks a lot.

Billy: I do want to ask you something.

Jack: Okay. Shoot.

Billy: I may be way off base here but I got the feeling you were pushed into this. Am I right, Jack?

Brad: Do you wake up in the morning thinking of ways to make people's lives miserable?

Jill: This is important.

Brad: So is the sanctity of a person's home.

Jill: This is an emergency.

Brad: If Jack and Phyllis want to shack up together, there's nothing we can do about it.

Jill: If you have a child in danger, would you stand back and let it happen?

Brad: That's an absurd analogy.

Jill: Jabot is John's baby. You have invested a king’s ransom into it.

Brad: I'm aware of that, Jill.

Jill: There is a fox in the hen house. The fox and the rooster are on great terms. That's bad news for the rest of us chickens.

John: I'll see you in court. Beverly, go through your notes and put everything through the computer and get it over to judge Jennings' courtroom as soon as you can. Thanks.

Paul: What's going on? Were you able to get anything useful out of Tricia?

Ryan: The real trick is Tricia implied Matt killed Jordan.

John: Unless there is something  Tricia is not telling us. It sounds like she never saw a thing.

Ryan: What if we got proof what she said is true.

John: I have to get to court.

Paul: Tricia told you that Matt killed Jordan?

Ryan: Yeah, that's right.

Paul: Jordan was a player. He bought the drugs and he thought Nick was the dealer.

Ryan: How would he know that?

Paul: Clark must have set it up. When the police started nosing around, Clark had to cover his tracks.

Ryan: By eliminating Jordan.

Paul: Exactly. How does someone commit murder in the hospital and not get caught?

Ryan: Dr. Walker, how's she doing?

Reese: She'll be fine.

Paul: We were hoping you could answer a question for us.

Reese: I'll do my best.

Paul: Is it possible Jordan died from something other than the drugs?

Reese: This is about what Tricia said, if Matt slipped into Jordan’s room.

Ashley: Hey, godfather.

Neil: Ashley. You alone?

Ashley: I am.

Neil: Care to join me?

Ashley: I would.

Neil: Thank you for that photo of Abby. That girl gets more beautiful every week.

Ashley: I'm glad you enjoyed it.

Neil: I found a photo album downtown. If you don't have one, I would love to get one for you.

Ashley: How sweet are you. Thank you.

Neil: I should thank you. It's a pleasure to have something positive in my life. Especially these days.

Ashley: You sound pretty down. What's wrong?

Neil: It's just family stuff.

Ashley: Involving Olivia?

Neil: That's it. These days, that's always it.

Mamie: Olivia, your son is angry.

Olivia: I thought after some time, it'd pass.

Mamie: This has only been a few weeks. It could take a lifetime.

Olivia: Don't come down on me. I could use someone in my corner, anyone.

Mamie: I am in your corner, whether you realize it or not.

Olivia: That's good. Things could get pretty ugly.

Mamie: They don't have to.

Olivia: Tell that to Malcolm. He's the one that's threatening to go to court. I know who put him up to it, that Alex woman. I'm sure she put that idea in his head. She's encouraging him. Have you spoken to Neil recently?

Mamie: Why do you ask?

Olivia: He decided to stand firm with his brother and testify that Malcolm should have visitation rights.

Mamie: I don't know why that shocks you? You know he doesn't condone your decision.

Olivia: I can't believe he would side with Malcolm.

Mamie: It's about what's best for that little boy.

Olivia: This is a slap in the face. Aunt Mamie, I know you and I disagree but you wouldn't betray me like Neil.

Victor: Son. Remember what I told you in the car. Do not lose your temper in front of the judge. Keep your cool.

Nicholas: Right. What about Tricia's statement?

Victor: I think that's John Silva's --

Nicholas: He better have something for me, dad.

Judge: All rise. Court is now in session. Be seated. -- Glad you could make it, Mr. Silva.

John: Sorry, your honor.

Judge: I understand you want to try to the bench.

John: Try by information not by indictment. 

Judge: Is that your decision, Mr. Newman?

Nicholas: Yes, sir.

Judge: You understand your rights are waived.

Nicholas: Completely, sir.

Judge: Do you have a problem with what the defendant is proposing?

John: No, your honor.

Judge: Do you wish to make an opening statement?

John: Yes, I do.

Ashley: Thank you. Let me guess, Olivia is standing firm and won't let Nate spend any time with Malcolm.

Neil: It's like talking to a brick wall getting her to budge.

Ashley: It's a horrible situation.

Neil: Which is about to get worse.

Ashley: What's that mean?

Neil: Malcolm is taking Olivia to court. He feels he has to. Olivia's left him no alternative.

Ashley: Know what his chances are?

Neil: The court feels they're reasonably good.

Ashley: There are no guarantees.

Neil: If Olivia forces us to go to court. We will do our best.

Ashley: Are you testifying for Malcolm?

Jack: No, I wasn't pushed into living with Phyllis.

Billy: It was your idea.

Jack: Not exactly.

Billy: That's what I thought.

Jack: I know Phyllis can be pretty intense and yes she exacerbates me. Your big brother is not forced to do anything he doesn't want to do.

Billy: Okay.

Phyllis: Where's John?

Billy: He had to leave for the office.

Phyllis: Oh.

Billy: And I have to get to school.

Phyllis: Billy, I made you some toast. Boysenberry jam. It might be a little messy. Bag's a little sticky.

Billy: Thanks. See you guys later.

Jack: See you later, Billy.

Phyllis: All right. Now it's just us. That went well. Our first breakfast at the Abbott house.

Jack: You certainly carried your weight.

Phyllis: That's your way of saying I overdid it, right? I know it's not a perfect fit, Jack. Your dad is not very pleased with my being here. I'll work on him. He'll come around.

Jack: Yeah, yeah. A piece of advice. I know how much this means to you. Don't try so hard. Don't push. Just let it happen.

Phyllis: All right. It means a lot to me. I've never been part of a family, at least not one that functions.

Jack: You never do talk about your childhood.

Phyllis: What's there to talk about? It wasn't a Norman Rockwell painting. My parents labeled me a bad seed and it went down from there.

Jack: I'm sorry about that.

Phyllis: I know this is a temporary arrangement. If I'm here even for a little bit, you have no idea what that means to me. What?

Jack: I just want to remind you, you don't have to push. You don't have to try. Eventually everyone is going to see everything the way we do.

Phyllis: Deal.

Jack: And I don't want to sound like a broken record.

Phyllis: You want to bring up Jill.

Jack: I just don't want you looking for trouble.

Phyllis: Is that what you think I'm doing?

Jack: I know you. You could be kind of --

Phyllis: I think the word you're looking for is protective. I have a lot at stake. I'm finally happy, Jack. I don't want Jill to ruin that.

Jack: What if she tries?

Phyllis: We know about her fling with Sean. That leaves her vulnerable, don't you think? Fine. I won't provoke anything. I understand. If she's planning another move against us, all bets are off.

Brad: I won't deny that Phyllis can make some mischief. Jill, our options are limited.

Jill: See, that is exactly the kind of thinking that got us where we are right now. You have to be creative. You have to do more than issue warnings to Jack.

Brad: The way you're talking, you got the impression you want somebody besides yourself to do the dirty work.

Jill: You have to do more than tell Jack that it's unacceptable for him to live with the competition's internet maven. You have to take action.

Brad: You keep saying "you". I assume you mean Ash and me. Someone clip your wings, Jill?

Jill: I am so tired of being the person that sticks her neck out. Let Jill do it. Jill's the only one that will say what needs saying or do what needs doing. I'm tired of being the bad guy all the time.

Brad: I never have known you to walk away from a fight. Phyllis threaten you?

Jill: What I'm doing ain't working.

Brad: We will keep an eye on the situation, okay? Now be careful. Don't overreact. I have to get ready for work. Show yourself out.

Jill: I'm afraid the time for being careful has passed. All the rest of you might be afraid of Phyllis Summers, but I'm not.

Mamie: Olivia, I wish you would think twice about this. You said it yourself, things could get so ugly. Fix it while you can.

Olivia: How?

Mamie: Since Malcolm is determined to pursue this, give him visitation on a trial basis.

Olivia: No way. I tried it before. It was a mistake.

Mamie: You can't use this boy as a weapon.

Olivia: That's not what I'm doing. Malcolm is not a good role model. I don't want him influencing my son.

Mamie: That's your final decision?

Olivia: Yes.

Mamie: Well then, I think you should know if this goes to trial and you feel that you need my testimony, I'm afraid I won't be able to give it.

Olivia: I see.

Mamie: Please understand, Olivia --

Olivia: I think you should go, Aunt Mamie.

Mamie: Honey --

Olivia: I mean it. I want you to go now.

Neil: Yes, Ashley, I am testifying for my brother. I hate being caught in the middle, but I have to do what's best for Nate.

Ashley: Does Olivia know?

Neil: She looked so betrayed.

Ashley: I'm so sorry.

Neil: I have to warn you, she may ask you to get involved.

Ashley: I doubt it. I made my position on this very clear. I know we all have.

Neil: You know, I just don't get it. Why is she being so stubborn with all of us telling her not to do this?

Ashley: You know she's a loving person, a fantastic friend. I think she's painted herself in a corner. I hope when she calms down and re-assesses the situation, she will drop this idea of fighting Malcolm in court.

Neil: Yeah.

[Phone ringing]

Olivia: I'd like to speak to Michael Baldwin. It's Olivia Winters.

Secretary: He's not in yet. Can I take a message?

Olivia: I would like to schedule an appointment.

Secretary: Can I ask what this is regarding?

Olivia: I would like him to represent me. Have him call me.

Secretary: Will do.

Paul: So is it possible? Is there some way Matt could have murdered Jordan and made it look like natural causes?

Reese: There are a number of ways to kill someone in Jordan's condition.

Ryan: Working quickly without a trace?

Reese: The easiest way is switch off the ventilator.

Paul: Doesn't it have an alarm?

Reese: But it can be disabled.

Ryan: Wouldn't the nurse notice Jordan was in trouble. There would have been an elevated pulse.

Reese: Someone would have rushed down and turned the ventilator on. Jordan's pulse remained steady. It was being monitored at the nurses' station.

Paul: What if someone disguised a change in pulse. Is there a way to do that?

Reese: There's a chance if the readouts weren't destroyed.

Paul: What?

Reese: I have to check on something. Ill get back to you. -- I'll get back to you.

Prosecution: During these proceedings, your honor will here testimony from the officer stationed in Matt Clark's room. He will tell you it was Mr. Newman who asked him to leave his post to go get a nurse. But this was done so Mr. Newman could remove the breathing tube from Matt Clark's throat. Now, your honor, this ultimately killed him. As I said earlier, the witnesses I bring before you will leave no doubt in your mind that Nicholas Newman is guilty as charged, on all counts.

Judge: Mr. Silva.

John: May I reserve my opening statement, your honor?

Judge: Yes. Call your first witness.

John: That won't be necessary, your honor.

Judge: Are you entering a guilty plea?

John: No. We most definitely are not. It's just it won't be necessary for Mr. Richards to call any witnesses. We're willing to stipulate that every witness he mentioned in his opening statement will testify as set forth in that statement.

Prosecution: I'd be crazy to turn that down.

Judge: So stipulated. Mr. Silva, I believe there's someone here to see you.

John: Yes. Thank you, your honor.

Victor: Is this the testimony from Tricia McNeil?

John: Yes, it is.

Victor: Is it going to help?

John: It's a piece of the puzzle. Beyond that, I can't really say.
